Narendra Modi cabinet clears 'Triple Talaq' bill

Government to make Triple Talaq non-bailable offense

The development comes few months after the Supreme Court in a historic judgment declared the practice of "triple talaq" unconstitutional. Reports suggest the Bill not only seeks to criminalize instant triple talaq, but also proposes to provide compensation for the affected women and their children.

All India Majlis-e-Ittehadul Muslimeen leader and Lok Sabha MP Asaduddin Owaisi however opposed the Bill, shooting off a seven-page letter to Law Minister Ravi Shankar Prasad expressing his concern that "a constitutional value as important as gender justice is being used to merely further cynical political goals".

That the government is giving top priority to the Bill can be gauged from the fact that it has already submitted a list of more than 25 bills that are to be tabled in the ongoing Winter session.

Triple talaq - the practice of Muslim men uttering talaq three times for an instant divorce - is worse than murder, said BJP minister Giriraj Singh on Friday. The draft bill will also recommend the right to seek compensation and maintenance for children.

It holds triple talaq in any form-verbal, written or send through electronic means such as an SMS or email - as "illegal and void". The Modi said cleared in November that they are ready with a bill that would take legal actions to prosecute Muslim men calling off marriages by saying "talaq" three times, which was outlawed by the Supreme Court.

Violators can get three-year jail term. Zakia Soman, founder of Bharatiya Muslim Mahila Andolan (BMMA) who hails from Ahmedabad, said, "The Cabinet clearing the Bill is a welcome step but what India requires is a comprehensive law on Muslim marriage that will end all kinds of injustice to Muslim women like nikah halala (divorced woman required to marry again and consummate it to be able to return to her first husband) and polygamy". Many in the government and opposition have termed it as a progressive bill which fulfills the demands of basic human right for the Indian Muslim women.
