Pakistan Supreme Court Rules Nawaz Sharif Can't Head His Own Party

The ruling Pakistan Muslim League-Nawaz (PML-N) as well as pro-government political analysts have termed the Supreme Court's verdict which barred Nawaz Sharif to head a party as a contrivance which will further strengthen the former prime minister. It citied articles 62 and 63 of the Pakistani Constitution, which state that a disqualified individual can not lead a party, Pakistan Today reported.

Faisal Chaudhry, a lawyer for one of the 17 opposition party petitioners who sought Sharif's removal as party head, said the court decision invalidated all of Sharif's decisions since last July, including the candidates he nominated for the Senate election.

In the verdict read out by the chief justice, it was also stated that a party's presidency is directly related to the parliament. As a result of the verdict, all decisions taken by Nawaz Sharif as PML-N's president stand null and void.

The judgment brushed aside the controversial Election Act 2017 which after being passed by both Houses of the Parliament previous year had paved the way for Nawaz Sharif to head the ruling PML-N after the Supreme Court's verdict on July 28, 2017 in Panama Papers Case deprived him the membership of the National assembly as well as the premiership. The court also annulled all decisions made by Nawaz Sharif as the party head.

Elections for the Senate, the Pakistani parliament's upper house, are due next month but would be postponed as a outcome of the Supreme Court ruling, he added.

According to Pakistan television channel Geo news, The former Prime Minister believes that he and his family would remain steadfast in the pursuit of its mission despite the use of underhand tactics by opponents.

Pakistan Tehreek-e-Insaf Chairman Imran Khan, Awami Muslim League chief Sheikh Rashid, MNA Jamshaid Dasti, National Party and the Pakistan Peoples Party (PPP), among others, challenged the law for allowing a disqualified parliamentarian to become a party head.

Control of both houses could allow the PML-N to change the constitution to make Sharif eligible to hold office again when the party contests general elections due later this year.

The bench was considering consequences of the anti-judiciary remarks by Sharif, whose party portfolio is under scrutiny in this case in view of the Panama judgment.

Nawaz Sharif has already served as Pakistan's prime minister twice, once from 1990 to 1993, and from 1997 to 1999.
