Washington becomes first state to pass net neutrality law after FCC repeal

Why Do Net Neutrality Supporters Oppose a Net Neutrality Bill

After last week's court decision, it seemed that there isn't much to be done about net neutrality, until Monday's move by the Washington State Gov. Jay Inslee.

He said that because the internet is an interstate service, only Congress can pass legislation "that gives all consumers and internet services providers the clarity and consistency needed for a free and open internet".

"This is a ideal example of why you need states' assistance when you've had the federal government walk off the job and go to the donut shop", Inslee said. More than half a dozen other states are also considering net neutrality legislation.

The state of Washington has put its foot down on the U.S. Federal Communications Commission's (FCC) net neutrality repeal, passing a new law that instead safeguards these protections. It also bans the throttling of certain Internet traffic-something providers have in the past done with Internet voice services-along with paid prioritization.

And multiple governors, including in NY and Montana, have signed executive actions that prohibit internet service providers with state contracts from blocking or slowing data on their lines.

Washington became the first state in the nation to require internet service be "net neutral" as Gov. Jay Inslee signed a bipartisan bill Monday afternoon. In any case, a legal fight is brewing along with the other legal fight-companies and groups that have begun to sue to roll back the December rule rollback, plus the effort by Hill Democrats-and one Republican-to nullify the Restoring Internet Freedom order via a Congressional Review Act resolution. Attorneys general in almost two dozen states, joined by public interest groups and internet companies, have sued to overturn the repeal. Nevertheless, consumers across the political spectrum were angered by the FCC's vote to repeal the rules, with many expressing concerns that the end of net neutrality could dampen free speech, lead to higher costs for consumers and allow ISPs to decide what services they use on the web. Washington's law will take effect June 6, two months after the FCC's new rules are slated to go into effect. The FCC's net neutrality repeal, however, isn't exactly a federal law, but a regulation from a federal agency.

Inslee said he's confident the states are within their rights to regulate internet service even though the FCC says no.
