Ex-Playboy model who claimed affair with Trump sues to break silence

McDougal is asking the court to declare the agreement null and void, saying that she was tricked into signing it; that it was meant to illegally influence the 2016 election; and that it violates public policy against using threats of legal action to get someone to stay silent on issues of public concern.

McDougal claims in the docs that Trump's lawyer, Michael Cohen, was secretly involved with AMI in the effort to pay her off and shut her up. because the head of the company, David Pecker, is friends with Trump and he had just secured the Republican nomination.

In papers filed with the Los Angeles Superior Court on March 20 and EXCLUSIVELY obtained by HollywoodLife.com, her legal team alleges that the tycoon and his campaign worked with AMI, the parent company of The National Enquirer, to keep her story from becoming public.

McDougal is the latest woman to take legal action over an agreement restricting her from speaking out about an alleged relationship with the President prior to his time in government.

Zervos claims Trump kissed her twice on the lips during a lunch meeting in his NY office in 2007 and, while in Beverly Hills, she alleges he kissed her aggressively and touched her breast.

A White House representative was not immediately available for comment on the ruling.

She rejected Trump's claim that he was immune from being sued, finding "absolutely no authority" to dismiss litigation related "purely to unofficial conduct" exclusively because he occupied the White House.

Along with Daniels, this makes McDougal the second woman to fight a legal agreement mandating her silence so she can expose an alleged extra-marital relationship with Trump.

McDougal signed a $150,000 deal with AMI for the story before the 2016 election.

McDougal gave her story to the National Enquirer in exchange for the money, but the publication engaged in what is known as a "catch and kill", in which the tabloid never actually runs the story.

The complaint claims, "Mr. Davidson's fee agreement granted him 45% of whatever Ms. McDougal received". (AMI), selling her story about her relationship with Trump in August 2016, as the Wall Street Journal has reported. She says that she wanted her account to be accurate and hired entertainment attorney Keith Davidson, who "assured her that the rights to publish the story were worth millions". The agreement reportedly keeps McDougal from sharing her story elsewhere and promised to run columns by McDougal and place her on two covers.

McDougal claims to have flown from Arizona to LA where she was interviewed for hours by AMI CEO Dylan Howard about the alleged affair.
