Officer Noor To Make First Court Appearance This Afternoon

Prosecutors argued yesterday that the former Minnesota police officer charged with murdering an unarmed Australian woman in July represents a flight risk and should face high bail.

"A person sitting in a passenger seat of a squad auto takes a gun, hears a noise, maybe sees some object ..."

After charges were filed Tuesday, the family's attorney Bob Bennett issued a statement on their behalf.

"There were concerns in the fall that Mr. Noor had left the country or the jurisdiction", she said.

The officer who shot Justine Damond is identified as Mohamed Noor, a Somali-American with less than two years of experience who became an officer after working in property management.

Mohamed Noor, 32, remains jailed after Judge Kathryn Quaintance set his bail at $400,000 on the condition that he turn over his passport, surrender his firearms and ammunition and refrain from contacting his partner Matthew Harrity, the lone witness in the shooting that drew worldwide outrage.

Ms Damond called 911 about a possible sexual assault behind her home minutes before she was shot.

Thomas Plunkett says Officer Noor was acting according to his training when he shot and killed Justine Ruszczyk Damond last July.

Freeman said he would decide whether to charge Noor in Damond's death, but convened a grand jury to gather additional evidence.

Supporters of Noor attended the hearing with Kiman Ugas, a Minneapolis community activist, claiming the "system failed" the U.S. police officer.

"These are hard jobs and tough questions. The police patrol, investigate, and present us cases-we evaluate those cases and have to make the charging decision and do the prosecution".

"Transcripts of 911 calls released by the police department on Wednesday showed that Ruszczyk phoned to say she was anxious a rape might be taking place outside her home".

He says Noor "violated the rules, and deserves to be charged" in Damond's death.

While both officers were wearing body cameras at the time of the shooting, neither camera was turned on at the time, nor was another camera in the police vehicle. Harrity was more experienced, closer to Damond and took his own gun out - but didn't shoot.

Justine Damond's father John Ruszczyk, was anxious the U.S. prosecutor investigating her death believes the initial investigation was not done accurately or thoroughly enough.

Noor has been on paid administrative leave since the shooting.

Matthew Harrity, the officer driving the police auto, said he was startled by a loud sound and both officers "got spooked" when Damond appeared out of nowhere, prosecutors said.

On Tuesday, Hennepin County Attorney Mike Freeman announced the charges against Noor, saying that he "abused his authority to use deadly force" when he shot Damond. Justine Damond had already started using the last name of her fiance at the time of the shooting.
