Judge Loya death case: BJP seeks Rahul Gandhi's apology

Congress president Rahul Gandhi on Thursday hit out at BJP chief Amit Shah after the Supreme Court verdict on Judge BH Loya's death, saying truth has a way of catching up with people like him.

In the 114-page verdict, a bench comprising Chief Justice of India Dipak Misra, justices A.M. Khanwilkar and D.Y. Chandrachud launched a stinging attack on the credibility of the petitioners. The Bench had reserved the judgment on the pleas on March 16.

Bhushan defended CPIL, which he said "got involved in the judge Loya case after seeing the case reports". Judges of the Supreme Court hear appeals arising from judgments rendered by judges of the high courts in which they served, either as judges or on appointments as Chief Justices.

Information and Broadcasting minister Smriti Irani said in a tweet, "Truth reigns supreme with SC judgement and political ploy to malign judiciary & @AmitShah ji fails".

The Supreme Court on Thursday dismissed Public Interest Litigations seeking Special Investigation Team to probe the untimely death of Loya in Nagpur. Suspicions were raised on whether Loya's death was natural after The Caravan published a report in November 2017, in which members of the judge's family raised a number of questions around the circumstances of his death and claimed that he had been under pressure at the time.

The petitions did not believe that Loya died of heart attack.

Cautioning against the rising misuse of PILs, it said, "There is a danger that the judicial process will be reduced to a charade, if disputes beyond the ken of legal parameters occupy the judicial space".

Meanwhile, the Bombay Lawyers Association, one of the petitioners, has chose to file a review petition in the Supreme Court against the verdict.

The apex court's decision labelled these petitions as "scandalous" and "an attack on the image of the Judiciary". "Had there been any doubt, the Supreme Court would have directed some enquiry".

Earlier on December 1, 2014, Judge Loya died while he was attending the wedding of his friend's daughter in Nagpur. "Congress president Rahul Gandhi should immediately tender his apology".

However, Loyas son had on January 14 said in Mumbai that his father had died of natural causes.

Spokespersons Sambit Patra and Gaurav Bhatia addressed one of them, held immediately after the verdict was announced. Amit Shah was discharged by a new judge, who said there wasn't enough evidence to merit a trial.
