President Naidu rejects opposition impeachment motion against CJI

Indian opposition parties submit motion to impeach chief justice of India

"All facts as stated in motion don't make out a case which can lead any reasonable mind to conclude that CJI on these facts can be ever held guilty of misbehavior", said Naidu further, reported ANI.

Vice-President Naidu's order drew sharp reaction from the Congress as spokesperson Randeep Singh Surjewala asserted that the Rajya Sabha Chairman "can't adjudge the motion, for he has no mandate to decide the merits of the motion".

He said it appears that the government at the Centre is not keen on holding an inquiry into the matter; by scuttling the inquiry, it does not want some information to come on record.

"We will move the Supreme Court to challenge the order", he said.

Naidu rejected the Congress-led opposition notice after extensive consultations with top legal and constitutional experts on the maintainability of the motion, sources said.

"Congress party has a long history of disrupting institutions of democracy", said BJP leader Meenakashi Lekhi while addressing a press conference. "Conversation between third party with dubious credentials, which have been extensively relied upon, can not themselves constitute any material evidence against the older of the office of Chief Justice of India", the order further stated.

"One knows that they don't have any ground, they know that they can't impeach him". He found that the press conference by the Opposition members after submitting a notice to the Chair not only denigrated the office of CJI, but also violated Rajya Sabha rules.

Leaders of seven opposition parties had on Friday last met Naidu and handed over the notice of impeachment against the Chief Justice of India (CJI) bearing signatures of 64 MPs and seven former members, who recently retired. "They can approach the Supreme Court, and their petition will be dealt with by the court like any other", he added.

"It is a revenge petition after the falsehood of the Congress party has been established in the Justice Loya death case".

The opposition move was criticised by legal experts including Former CJI K G Balakrishnan and R M Lodha and jurists like Fali Nariman. "I thought, I should, therefore, expedite my decision and end needless speculation", said Naidu. VP Naidu rejects impeachment motion against CJI signed by 64 RS MPs!

"There are procedures in the Constitution and the chairman of Rajya Sabha should have followed it instead of acting in a hurried manner", Chatterjee said.

We'll certainly file a petition (in Supreme Court) against this.
