Rudy Giuliani: President Trump could pardon himself, but he probably wouldn’t

Trump's lawyer Rudy Giuliani defended the president's statements, and told ABC's George Stephanopoulos that while Trump most likely will not pardon himself or shut down Robert Mueller's investigation he could do so if he wanted to.

"Thankfully, the President has not done anything wrong and wouldn't have any need for a pardon", White House Press Secretary Sarah Sanders told reporters.

On Monday, the president weighed in on the pardon discussion, declaring on Twitter that he has the "absolute right to PARDON myself". He then again decried special counsel Robert Mueller's probe as a "never ending Witch Hunt".

Trump tweets on Monday: "The appointment of the Special Councel is totally UNCONSTITUTIONAL!" "Despite that, we play the game because I, unlike the Democrats, have done nothing wrong!"

In a letter to Robert Mueller, the special counsel investigating the Russian Federation meddling, the president's lawyers argued in January that Trump "could, if he wished, terminate the inquiry, or even exercise his power to pardon if he so desired".

House Speaker Paul Ryan said Wednesday that President Trump should not pardon himself. "When he says the President is not contemplating something, I have no faith in that whatsoever", he said. "Pardoning other people is one thing, pardoning yourself is tough".

Giuliani also said, "Right from the very beginning, this is a tainted investigation", referring to Comey's illegally leaked memo.

The letter is dated January 29 and addressed to Mueller from John Dowd, a Trump lawyer who has since resigned from the legal team. He said he has informally made the request, but gotten no response.

While saying on Sunday that Trump wanted to sit down with Mueller, Giuliani added, "It's beginning to get resolved in favour of not doing it".

Mueller's team is investigating whether the Trump campaign colluded with Russian Federation during the 2016 election, as well as whether Trump tried to obstruct the FBI's investigation of his campaign, including when he fired former FBI Director James Comey.

Bharara said on "State of the Union" that he doesn't believe Giuliani's assertion that the President isn't considering granting himself a pardon. In a controversial tweet earlier this week, Trump touted that he has "absolute" power to pardon himself. "He's innocent. He hasn't done anything wrong".

Among the skeptics are White House Chief of Staff John Kelly and White House Counsel Donald McGahn, who upon reviewing the case argued that it was unnecessary for Trump to carry out the commutation. "He's got to have the discipline to put a stop to it, or we're going to have to do everything we can, including some things that I don't think we'd want to talk about right now, to try to, to try to appeal to have it stopped", he said.

Trump's legal team has also argued that the president shouldn't have to answer any questions, even if Mueller issues a grand jury subpoena, citing Trump's executive authority.
