Cohen, Trump's longtime personal attorney, taped and stored conversations with his associates and has argued that the seized recordings and documents are protected under attorney-client privilege.

Daniels is also suing both Cohen and Trump for defamation after the president accused her of lying about their relationship.

When Trump defender Alan Dershowitz, who also appeared on the segment, pressed Avenatti on how he would have obtained access to the tapes, Avenatti claimed that, "All of the information that the Federal Bureau of Investigation seized, that's not under lock and key".

Though the content of the recordings is not known, the disclosure of their existence comes days after news that Cohen secretly recorded his conversations with Trump.

Federal prosecutors investigating President Donald Trump's former personal attorney Michael Cohen are now in possession of 12 audio recordings seized during raids of Cohen's home, office and hotel room, according to new court filings. They include one in which Trump and Cohen discuss a potential payment to a Playboy model who claims she had an affair with Trump that had been revealed last week.

"It is not illegal if you are in a one-party consent state and what that means is if there are two parties to a conversation, only one needs to know about recording the conversation so it's not illegal, however there may be a question of ethics here", said CBS News legal analyst Rikki Klieman. Federal prosecutors in NY are investigating Cohen for possible bank and tax fraud, and for possible campaign law violations linked to a $130,000 payment to adult film star Stormy Daniels and other matters related to Trump's campaign, a person familiar with the investigation has told Reuters. Since the search warrants were executed in April, lawyers for Cohen, Trump and the Trump Organization have been engaged in a laborious process of reviewing more than 4 million items seized in the raids.

"The transaction that Michael is talking about on the tape never took place, but what's important is: If it did take place, the president said it has to be done correctly and it has to be done by cheque" to keep a proper record of it, Giuliani said.

"All of the information that the Federal Bureau of Investigation seized, that's not under lock and key", he said, adding: "I could have received it from Michael Cohen. I could have received it from Michael Cohen; I could have received it from Michael Cohen's counsel; I could have received it from others".

"Mr. Cohen's legal matters will not be tried in the court of public opinion, but in a court of law", Blakely said.
